Overview

The terms “we”, “us” and “our” refer to WYRD. WYRD operates this store and website, including all related information, content, features, tools, products and services (the “Services”). WYRD is powered by Shopify, which enables us to provide the Services to you. These Terms, together with any policies referenced, describe your rights and responsibilities when using the Services.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy.

Section 1 — Access and Account

You represent you are at least the age of majority in your jurisdiction and you consent to minors using the Services on devices you own or manage. You may be asked to provide information (email, billing, payment, shipping). You warrant all information is current, correct and complete and that you have rights to provide it. You are solely responsible for safeguarding your credentials and all activity on your account. You may not transfer, sell, assign, or license your account.

We strive for accuracy, but colors/appearance may vary by device and settings. We do not warrant that products/services meet your expectations or match renderings. Descriptions may change without notice. We may discontinue products or limit quantities to any person/region/jurisdiction.

Section 3 — Orders

Your order is an offer to purchase. We may accept or decline at our discretion and must process payment before acceptance. Changes/cancellations may not be possible after acceptance. If we do not accept, change, or cancel, we will attempt to notify you via the contact details provided.

Purchases are subject solely to our Refund & Return Policy. You warrant purchases are for personal/household use and not for resale or export.

Section 4 — Prices and Billing

Prices, discounts and promotions may change without notice. The price charged is the price in effect when you order and appears in your confirmation. Unless stated, prices exclude taxes, shipping, handling, customs and import charges. Promotions may be subject to separate terms that control in case of conflict.

You agree to provide accurate purchase, payment and account information and to keep it updated. You represent that your payment method is valid and authorized and that all charges, taxes, shipping and handling will be paid.

Section 5 — Shipping and Delivery

Delivery times are estimates and not guaranteed. We are not liable for delays caused by carriers, customs, or events outside our control. Title and risk of loss pass to you upon transfer to the carrier.

Section 6 — Intellectual Property

The Services and all content are owned by WYRD, its affiliates or licensors and protected by applicable laws. You may use the Services for personal, non-commercial use only. Except as permitted, you may not reproduce, distribute, modify, create derivative works, display, perform, republish, download, store or transmit any content without prior written consent. WYRD and Shopify trademarks may not be used without permission. All other trademarks are the property of their owners.

Section 7 — Optional Tools

Third-party tools provided through the Services are offered “as is” and “as available” without warranties or endorsements. Use is at your own risk and subject to third-party terms. Future features or tools will also be part of the Services and subject to these Terms.

Section 8 — Third-Party Links

The Services may contain third-party materials or links. We are not responsible for their content, accuracy, policies or practices. Access and transactions with third parties are at your own risk. Direct complaints or questions about third-party products/services to the third party.

Section 9 — Relationship with Shopify

WYRD is powered by Shopify. Sales and purchases are made directly with WYRD. Shopify is not responsible for any aspect of sales between you and WYRD. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with WYRD.

Section 10 — Privacy Policy

Personal information collected through the Services is subject to our Privacy Policy. Because the Services are hosted by Shopify, Shopify may collect and process information about your access and use to provide and improve the Services. See our Privacy Policy for details on how we, Shopify and partners use personal information.

Section 11 — Feedback

If you provide ideas, reviews or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback for any purpose. You warrant you have rights to the Feedback, have disclosed any incentives, and that it complies with these Terms. We may monitor, edit or remove unlawful or objectionable Feedback at our discretion.

Section 12 — Errors, Inaccuracies and Omissions

Information on the Services may contain errors or omissions (e.g., descriptions, pricing, promotions, shipping charges, transit times, availability). We may correct or update such information or cancel orders if information is inaccurate at any time without prior notice (including after order submission).

You agree not to violate laws; infringe IP rights; harass or harm others; transmit misleading information; send spam; impersonate others; upload non-compliant content; or engage in conduct that restricts or harms other users, WYRD or Shopify. Do not upload malware, exploit the Services, collect personal data unlawfully, or interfere with security features. We may suspend or terminate accounts that violate these Terms.

We may terminate this agreement or your access at any time, in our sole discretion, without notice. You remain liable for all amounts due up to and including the termination date. Provisions that by nature should survive termination shall continue in effect.

Section 15 — Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED BY WYRD, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE SERVICE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS; THESE MAY NOT APPLY TO YOU.

Section 16 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WYRD AND ITS AFFILIATES, PARTNERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS AND LICENSORS, AND SHOPIFY AND ITS AFFILIATES, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, SAVINGS, DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY.

Section 17 — Indemnification

You agree to indemnify and hold harmless WYRD, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from claims and liabilities arising out of your breach of these Terms, violation of law or third-party rights, or your use of the Services. We may control the defense and settlement; you will cooperate and provide documents as needed.

Section 18 — Severability

If any provision is held unlawful, void, or unenforceable, it will be enforced to the maximum extent permitted and the remainder will continue in full force.

Section 19 — Waiver; Entire Agreement

Failure to enforce any right is not a waiver. These Terms and posted policies constitute the entire agreement and supersede prior communications. Ambiguities will not be construed against the drafting party.

Section 20 — Assignment

You may not assign or delegate these Terms without our written consent. We may assign or delegate without notice.

Section 21 — Governing Law

These Terms and any separate agreements for Services are governed by the courts in the jurisdiction where WYRD is headquartered. You consent to venue and personal jurisdiction there.

Headings are for convenience only and do not affect interpretation.

Section 23 — Changes to Terms of Service

The most current version will always be available on this page. We may update, change, or replace any part of these Terms by posting updates. We will notify you of material changes as required by law. Continued use after changes constitutes acceptance.
